Rules for creators and learners

1. Agreement and scope

These Terms of Use (Terms) govern access to the LearnForgePlus website, creator tools, AI services, course hosting, learner experience and related features (Services). By registering for an account or expressly accepting these Terms, you enter into an agreement with the operator of LearnForgePlus. If you act for an organisation, you confirm that you have authority to accept these Terms for it.

Additional conditions disclosed before a particular purchase, including plan particulars and a separately agreed Custom subscription, form part of that transaction. If a condition conflicts with a mandatory consumer protection, the mandatory protection prevails.

2. Eligibility, accounts and account security

You must have the legal capacity to agree to these Terms, or the relevant consent and supervision required by law. Account details must be accurate and kept reasonably current. You must protect account credentials, restrict administrative permissions appropriately and notify us promptly if unauthorised access is suspected.

You must not share access in a manner that defeats licence or administrator limits. We may require authentication or verification proportionate to fraud prevention, security and payment processing.

3. Subscription plans and service allowances

The features, prices, billing periods, course limits, storage allowances, AI credits and other usage entitlements available under each subscription are described on the pricing page and, where applicable, in the information displayed before checkout or in a separate written agreement. These commercial details may be updated from time to time and are not fixed by these Terms.

The information presented and accepted at checkout governs the purchased subscription for the period to which it applies. A plan may include usage limits, technical safeguards and service-specific restrictions that will be disclosed before purchase or when the relevant feature is accessed. Fees, taxes and recurring billing conditions must be presented in accordance with applicable law.

We may introduce, discontinue or vary plans and features for future purchases and renewals. If a proposed change materially increases the price or reduces a paid subscriber’s contracted benefits, we will give reasonable advance notice, and provide an effective means of cancelling before the change applies, together with any refund or other remedy required by law. We will not apply a new price retrospectively to a completed billing period. Nothing in this section restricts non-excludable consumer rights.

4. Payment, renewal, changes and cancellation

Where a paid subscription renews automatically, the renewal interval, amount payable, applicable taxes and cancellation process will be disclosed before the subscription is accepted. You authorise the designated payment provider to collect charges in accordance with the terms presented at checkout.

You may cancel a subscription through available account billing controls or, where those controls are unavailable, by contacting the service using the details in these Terms. Cancellation stops future renewals once effective. Access to purchased services during an already paid period, and any entitlement to a refund or other remedy, remain subject to the accepted purchase terms and applicable law.

Changes to plans, prices or service allowances are dealt with under section 3. In particular, a material adverse change to an existing paid subscription will not be imposed without reasonable prior notice and any cancellation or statutory remedies required by law.

5. Creators, course sales and payment processing

Creators remain responsible for the accuracy and legality of their course descriptions, claims about qualifications or outcomes, content, advertised prices, delivery commitments and learner communications. Paid-course sales require a supported payment account that meets the payment provider’s onboarding and ongoing requirements.

Payment processing, payout timing, verification, disputes and processing fees are governed in part by the relevant payment provider’s agreement. Stripe transaction and processing fees may apply. The seller of a particular course and the parties responsible for its taxes, refunds and consumer obligations depend on the checkout arrangement and the applicable transaction documents. Nothing in these Terms relieves LearnForgePlus of an obligation it owes directly under applicable law.

Creators must not make statements about guaranteed employment, accreditation, qualifications, professional outcomes or external endorsements without a proper factual basis. Course pricing and refund information must be accurate, accessible and compliant with applicable law.

6. Ownership of course materials and permitted platform use

As between you and LearnForgePlus, you retain rights in content you lawfully own and upload. You grant LearnForgePlus a non-exclusive, worldwide, royalty-free licence, for so long as reasonably necessary, to store, host, back up, reproduce, adapt into technical formats, transmit and display your content solely to operate, protect and deliver the Services as instructed or authorised.

You warrant that you have sufficient rights and permissions to provide any third-party intellectual property, personal information, images, audio or video you upload. You must respect applicable licences, confidentiality duties, privacy laws and any rights held by learners or other third parties. The licence ends when no longer needed to deliver the Services or meet lawful retention and dispute obligations.

7. Artificial intelligence and user responsibility

LearnForgePlus may offer separate tools for course creation, lesson editing, quiz generation and image generation. Results are generated automatically and can be inaccurate, incomplete, misleading, inappropriate or similar to third-party material. You must check accuracy, suitability, permissions and legal compliance before using or publishing content, without limiting any consumer guarantees that cannot lawfully be excluded.

Your use of AI tools, including prompts, reference images, uploads and generated outputs, is subject to our AI Content & Safety Policy. You must not request, create, upload, store, publish or share prohibited material. An AI provider’s acceptance of a request does not mean the content is permitted on LearnForgePlus.

AI features may rely on external providers with separate safety restrictions and service terms. Availability, content filters and output behaviour can vary with the feature and provider. Do not upload confidential personal data, or images of identifiable individuals, without a lawful basis and the permissions required for that processing.

8. Acceptable use and content restrictions

You must comply with our AI Content & Safety Policy, the Content Takedown process and all applicable laws. Prohibited conduct includes generating or distributing pornographic or sexually explicit imagery, material that depicts, exploits or sexualises a person under 18, non-consensual intimate images, sexual violence, harassment, targeted abuse, fraud, unauthorised impersonation, malicious code or infringements of intellectual property and privacy rights.

You must not create sexual or intimate deepfakes, including manipulated images of identifiable individuals without their informed consent; use another person’s identity, likeness or data without necessary rights; or create or facilitate content intended to harm or exploit children. These restrictions apply equally to generated and user-supplied material, whether public or private within an account.

You must not attempt to bypass safety filters, moderation, authentication, access controls, rate limits or payment systems, or use automated access without authorisation except where permitted by law. A request that successfully produces an image or other output does not establish that the use is authorised.

9. Content review, enforcement and termination

Where reasonably necessary to address safety concerns, suspected legal violations, infringement, payment fraud or material breaches of these Terms, we may investigate reports, block a prompt, restrict access to content, remove content, suspend relevant features or close an account. We will assess the circumstances proportionately, particularly where immediate action is needed to protect children or other persons.

We may preserve relevant records and disclose information to law enforcement or other competent authorities where required or permitted by law, consistently with our Privacy Policy. We do not guarantee that automated safeguards will identify every prohibited use.

Except where law, safety or investigation needs reasonably prevent it, we will seek to communicate material enforcement actions and provide a means to request review. Cancellation or termination does not remove accrued rights, existing obligations or non-excludable consumer remedies.

10. Availability, liability and consumer protection

We may carry out maintenance and security work. We do not guarantee uninterrupted operation or that every feature is suitable for every professional, educational or commercial purpose. Any service descriptions or availability commitments expressly made at purchase remain relevant.

Nothing in these Terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, including guarantees under the Australian Consumer Law. Where those rights apply, you may be entitled to a repair of the service, cancellation, refund or compensation according to the nature of the failure and the applicable law.

Otherwise, liability is determined under applicable law. No provision is intended to operate as an unfair contract term or to exclude liability where doing so is prohibited. You remain responsible for loss caused by unlawful conduct or a breach of these Terms to the extent recognised by law.

11. Disputes, applicable law and contact

We encourage you to raise service or billing concerns promptly so they can be considered and, where appropriate, resolved without formal proceedings. Queensland law governs these Terms, subject to any mandatory rights that apply in other jurisdictions. This does not limit a consumer’s ability to exercise rights under applicable legislation.

Service and account enquiries may be sent to contact@learnforgeplus.com. Legal notices, contractual disputes and privacy matters may be directed to legal@learnforgeplus.com. Suspected AI misuse or harmful content may be reported to safety@learnforgeplus.com; copyright complaints should follow the Content Takedown procedure.
